2. Client Responsibilities

To ensure successful project delivery, the client agrees to:

  • Provide accurate, necessary information, text copy, and imagery required for the project in a timely manner.
  • Review deliverables and provide consolidated feedback within the agreed-upon revision windows.
  • Ensure they have the legal right and copyright permission for any brand assets or images they provide to zesto.tech for use on their website.

3. Intellectual Property Rights

Upon receipt of full and final payment, the client will retain full ownership of the final website design and the provided assets. zesto.tech retains the right to use the completed project, including screenshots and links, in our portfolio, marketing materials, and case studies unless a non-disclosure agreement (NDA) is explicitly signed beforehand.

4. Payment Terms

All projects require an upfront deposit as outlined in your specific project proposal before any work commences. Final delivery and transfer of ownership (including domain transfer or code handover) will only occur after the final invoice is paid in full. Late payments may result in a pause in services or project delays.

5. Revisions and Scope Creep

We build our projects based on a defined scope of work. Any requests for additional features, pages, or substantial design changes outside the original agreement will be considered "scope creep" and may incur additional charges, which will be communicated and agreed upon before proceeding.

Legal Disclaimer & Terms of Engagement

Separation of Entity and Founder: By interacting, communicating, or doing business with zesto.tech, any individual, organization, or entity explicitly acknowledges and agrees that zesto.tech and its founder(s) are strictly separate and distinct entities.

Limitation of Personal Liability: The founder(s) of zesto.tech shall bear absolutely no personal legal responsibility or liability for any business operations, acts, omissions, debts, representations, or obligations of the business. Any and all matters of business, whether legal or otherwise, are to be dealt with exclusively through the business entity, zesto.tech.

Governing Law and Jurisdiction: Any dispute, claim, or controversy arising out of or relating to your interaction, engagement, or business with zesto.tech shall be governed by, construed, and dealt with strictly under the laws of the advanced Indian legal system. Furthermore, any legal proceedings or dispute resolutions shall be conducted exclusively at a specific location and jurisdiction of zesto.tech's choosing within India.

6. Warranties and Guarantees

While zesto.tech engineers websites following best practices for SEO and performance, we cannot guarantee specific rankings on search engines like Google, nor can we guarantee a specific volume of sales or leads. Search engine algorithms are managed by third parties and are subject to change without notice. All services are provided "as is" without warranty of any kind, either expressed or implied.

7. Termination of Services

zesto.tech reserves the right to suspend or terminate services if a client breaches these Terms, engages in unlawful activities, or if communication breaks down to the point where project completion is impossible. In the event of cancellation by the client after work has commenced, the initial deposit is non-refundable, and the client will be billed for any work completed up to the point of cancellation.
